Покупать такую дорогую вещь у продавца с таким огромным количеством негативных фидбэков (на последней странице ни одного положительного) - рисковый вы парень я смотрю Стараюсь не покупать дорогие товары у продавцов с рейтингом ниже 99.8% (безделушки беру у продов с рейтом не ниже 99%) и с парой негативов за последний месяц.
Приветствую. К сожалению, почта наша дико тормозная. Из местного ОПС посылку перенаправили в отдел по претензиям. Там она находится уже месяц и, вроде как, в скором должна отправиться в штаты (предварительно заехав еще в какое-то отделение). Срок (45 дней) уже поджимает. На сколько я понимаю, после этого срока я уже не смогу что-либо предъявить продавцу (хотя он, по идее, до сих пор ждет обратно посылку). Что посоветуете делать? Спасибо.
Продавец ничего не говорит. Я ему, как тут посоветовали, написал, что посылка была, вскрыл ее в присутствии сотрудников почты, а там внутри подделка, что составили акт и отправили обратно. Он на это тогда ответил, что он непричем, но будет ждать, когда она до него дойдет обратно....
Я правильно понимаю, что завтра (15го) надо открывать диспут, а послезавтра (16го) - в клейм? Или можно можно не дожидаться и сразу это сегодня делать?
Я открыл утром Case на , сейчас вроде как его пока в Claim нельзя перевести (What you should know: If you don't hear from the seller by Jun 21, 2011, you can escalate this case to Customer Support.). Как я понимаю, в Claim можно будет перевести только после 21 июня.
Скажите, надо ли мне еще на палке создать диспут? Спасибо.
Приветствую... В общем, ситуация следующая... Открыл кейс вчера днем:

Additional information: "Hello. The morning of 17 may I received a notice that there is a parcel for me from the post office. I went to the post office and filed the notice. Packing of parcel was _not_ damaged. Together with the post-office staff we opened the parcel. Inside we saw carton box JA Henckels and opened it. Inside, we saw a stand for knives and small box with the knives. When we opened it, we saw that there are not JA Henckels knives. It a cheap Chinese fakes labeled Chefmate. In addition, the elements were only 11, not 13. We wrote an act and sent parcel back. I'm sure the seller wished to deceive me and specially sent a fake. Please, see photos: In addition, as is evident from the customs declaration, the seller specify cost only $ 50 instead of $ 180
Т.е. написал все как было - пришла посылка, вскрыли при сотрудниках почты, увидели там подделку и отправили обратно. Фотки, пожалуйста, смотрите...
Продавец ответил следующее:

Most cases, customs will actually hold a package until they clear it themselves of its true Authenticity. Some cases, it can take as long as 8 weeks for a customer to receive their package. We are terribly sorry for this long wait. I would wait at least another two weeks, but in the mean time please try contacting your customs to see if the package is in fact being held with them. Т.е. если я правильно понимаю, то он написал что очень извиняется, что до меня еще не дошла посылка... и ни слова о подделке и т.д.
Мой ответ с передачей диспута в службу поддержки:
Hello. As You can see, the seller did not even read my post. I wrote that the parcel arrived and I opened it with the staff of the post office. Final decision: This case has been decided in the seller's favor. Customer Support comments: To keep safe, we may limit the number of cases a member can open or the dollar value of those cases.
Т.е. решилось в почему-то в пользу продавца. А причем тут ограничение на кол-во кейсов я вообще не понял....
Что посоветуете делать? Спасибо.

Продавец оказывается еще написал мне (и, видимо, суппортам) следующее:

Firstly, you are absolutely correct that there are only 11 knives in the box. All knife manufacturers call them piece sets. They are including the kitchen shears and the wood block as pieces so thats how they arrive at 13 pieces. I know that is fairly confusing but it is how the industry chooses to label the sets. Secondly all of JA Henckels International knives are made in China. The only knives that they make in Germany are the Zwilling JA Henckels knives. The easy way to tell the difference is that the Zwilling knives have two little guys on them and the JA Henckels International knives have only one little guy on them.
Iknow that you are very concerned but we sell hundreds of knife sets each year and I can guarantee you that the knives you purchased are a wonderful knife set and carry the full lifetime henckels warranty
Зря ты написал про Chinese fakes!.. Они действительно все делаются в Китае. Американцам это не понять - у них почти весь товар китайский и высокого качества. решил что ты претендуешь на made in Germany. Надо было напирать на то, что внешне это совершенно другие ножи = типа без лейбла, мягкая сталь и пр. Прод явно отсылает не то, что рекламирует - ты неправильно расставил акценты в диспуте. все его стандартые отписки - это "вода" которую Ebay'цы и не читают толком: типа "русский дурачок выступает". Но теперича поезд ушел! По идее, тебе в лучшем случае должны вернуть стоимость товара за вычетом пересылки - вроде так, почитай Return policy..
На сколько я понял, я могу обжаловать диспут (апелляция есть). Видимо, в ней и надо коротко и ясно указать, что на фотке ножи одни, а в реале другие... Может еще кто-нибудь что-нибудь посоветует?
Обжаловал решение ебея (апелляция кейса) - описал все более подробно, указал, на что смотреть чтобы ясно понятно было, что ножи не те. Они думали 5 дней, теперь старый кейс остается закрытым, а они открыли новый - "Item not as described". Ожидается ответ продавца...
PHOENIX2000 Молодец - сейчас все правильно сделал! Теперича жди - думаю все бабосы взад получишь, включая пересылку после того как все вернется проду. На все вопросы в диспуте тупо отвечай: на фото у прода одни ножи - прислал другие, в жизни бы такие не покупал - в соседнем магазине по 3 рубля они есть. И точка! Правда за тобой.
Где сейчас находится посылка толком на почте никто сказать не может. Мне от них уже три письма пришло. Но буду надеяться, что вскоре оно приедет обратно продавцу. Кстати, а почему оно обязательно должно вернуться продавцу? Ведь я мог бы обнаружить подделку только дома и не отправлять обратно этот хлам. Продавец на новый кейс пока ничего не ответил.
Гхм.... В общем я не знаю что там им плетет селлер... Как я уже говорил, открыл новый кейс для меня, что товар не соответствует описанию в Jun 21, 2011 at 6:30 AM.

И как теперь это понимать? Они говорят, что товар полностью соответствует описанию, а я просто больше такой товар не хочу. Я кстати уже у другого продавца заказал точно такой же набор... Что теперь делать? Апелляция возможна и на этот кейс. На всякий случай мой текст, который я писал в прошлый раз:
