Motorola S9-HD, возможность получения подделки.

Приобрел у продавца http://myworld.ebay.com/2dollors/ блутус гарнитуру Motorola S9-HD ( http://cgi.ebay.com/ws/eBayISAPI.dll?ViewItem&item=180420938329 ), сразу же оплатил.
Спустя день в фидбеке продавца начали появляться негативные отзывы на счет этой гарнитуры, народ утверждал что получил подделку, но при этом там были и положительные отзывы что получили гарнитуру и всё их устраивает.
Я сразу же написал продавцу:

На что получил ответ:

В общем проблема в том, что я не понимаю что я получу от продавца, подделку или оригинал, прошло уже 10 дней с момента оплаты, а продавец ещё не выслал товар.
Стоит ли ему написать почему он ещё его не отправил?
Что делать в том случае если товар окажется подделкой?

На фотке в описании - однозначно фейк... даже сомнений никаких не вызывает.
Сравните, хотя-бы с фотками отсюда
кстати, чисто черный цвет исполнения для этой гарнитуры - изрядная редкость... обычно, либо бело-голубой, либо черно-красный... но и полностью черные в оригинале тоже есть.
Больше похожи на обычные S9, но тоже не они

Получите подделку, с вероятностью 99%... китайцы вообще достаточно спокойно и непринужденно относятся к нарушению авторских прав.
Что делать - это вопрос второй - потестируйте гарнитуру... иногда китайские подделки абсолютно ни в чем не уступают оригиналу... если вас она устроит, можете потребовать баксов 20-30 частичного рефанда за "неоригинальность"... поторгуйтесь с китайцем, они это любят... тем-более фидов у него немного и нег для него весьма нежелателен. В результате можете стать владельцем неплохой гарнитуры за смешные деньги
Если захотите полного рефанда - придется за свои деньги отправлять обратно - лишние расходы... ну, разве-что нег влепите для морального удовлетворения.

вообще, по правилам, насколько я помню, отправка должна быть произведена в течении 3-х рабочих (?) дней, после получения оплаты...
в описании было, вроде 48 часов...

там, вообще, в письме от eBay всё сказано... если трудности с пониманием - ищите на форуме по фразе "No longer a registered user". Уже пару сотен раз обсуждалось.

Доверять ему или нет?
Открывать сразу диспут или подождать недельку, вдруг сам всё вернет?
Я могу ошибаться, но ведь он в принципе может за эту неделю вывести все деньги со счета и потом эти 44$ будет снимать уже неоткуда и далее только пэйпал может вернуть деньги.
Просто с подобной ситуацией я сталкиваюсь впервые, хотелось бы услышать мнение более опытных людей.
